1. BENU (also "we" "us") website(s) (our "Site", “Website”) and related services are made available to you in accordance with the following Terms and Conditions, and any other rules posted on our Site (collectively, the "TOS"). Please read the TOS carefully before using our site, our services and before placing any orders on www.benuarts.com. The access to and use of our web site, our services, as well as the purchase of products on www.benuarts.com are based on the assumption that these TOS have been read, understood and accepted by you.
2. BENU may amend or simply update all or part of these TOS. Any amendment or update to the TOS shall be posted on the Home Page of www.benuarts.com as soon as such amendments or updates have been made and shall be binding as soon as they are published on the web site in this section. Therefore, you should regularly access this section on the web site in order to check the publication of the most recent and updated TOS. If you do not agree to all or part of BENU's General Terms and Conditions of Use, please do not use our web site.
3. This website is managed and maintained by KONTOGEORGOS VAS. DIMITRIOS RETAIL TRADE OF GIFTS. The products purchased on BENU are sold directly by “KONTOGEORGOS VAS. DIMITRIOS RETAIL TRADE OF GIFTS” which has its registered office in EKALI (7B, Okeanidon Street) and TIN number 006675063.
5. The access to and use of BENU and its services, are carried out by our users exclusively for personal purposes, which should in no way be connected to any trade, business or professional activity.
6. Intellectual Property Rights
BENU’s contents, including but not limited to, works, images, pictures, dialogues, music, sounds, videos, documents, drawings, figures, logos and any other material posted on BENUARTS.com in any format, including menus, web pages, graphics, colours, schemes, tools, fonts, design of the web site, diagrams, layouts, methods, processes, functions and software which are part of BENUARTS.com, are protected as BENU’s intellectual property rights and of the relevant right-holders. The reproduction, wholly or in part, in any form whatsoever, of BENUARTS.com and of its contents is not allowed without BENU's written consent.
BENU has the exclusive right to authorize or prohibit any reproduction of its Site and its contents.
As far as the use of BENUARTS.com is concerned, you are only authorized to display the web site and its contents.
You are also authorized to surf on the web site for the lawful use of BENUARTS.com and its contents.
You are not authorized to reproduce by any means or in any form, in whole and in part, BENUARTS.com and its contents. Any reproduction must be authorized from time to time by BENU or, if applicable and necessary, by the authors of the work posted on our web site. Such reproductions shall be carried out for lawful purposes and in compliance with copyright and the other intellectual property rights of BENU and of the authors of the works posted on the web site.
You undertake to comply with the copyright of the authors who chose to publish their work on BENU or have cooperated with us in the creation of new expressive and artistic works which are intended for publication, not exclusively on the web site, or which are an integral part of the web site.
In any event, you are not authorized to use, in any manner or form whatsoever, the contents of the web site or any single work protected by copyright or any other intellectual property right.
7. BENU is the exclusive owner of the logo "BENUARTS" and the domain name "BENUARTS.com ".
All of the other signs which are used for distinguishing the products sold on BENUARTS.com posted on the web site are trademarks or of the respective owners and are used on our Site only for the purpose of distinguishing, describing and advertising the products sold on BENU.
BENU and all of the other owners of registered trademarks are entitled to the exclusive use of the trademarks respectively owned.
You are not authorized, without the consent of BENU and of any other owner of the trademarks posted on the web site, to use such trademarks for distinguishing products or services.
8. Links to Other Web Sites
BENU contains links to other web sites which are in no way connected to BENUARTS.com.
BENU does not control or monitor such third party web sites or their contents and shall not be held liable for the contents of such sites and/or for the rules adopted by them.
When BENU provides links to other web sites, does not recommend its users to access these web sites and it does not provide any guarantees to their web content or to services and products supplied and sold by these web sites to Internet users.
9. Disclaimers on Content
BENU has made all efforts to ensure that the content of the Site is accurate and does not contain any incorrect or out-of-date information.
However, BENU cannot be held liable for the accuracy and completeness of the content posted by BENU on its web site, except for its liability for tort and gross negligence and as otherwise provided for by the law.
Moreover, BENU cannot guarantee that the web site will operate continuously, without any interruptions and errors due to the connection to the Internet, suspensions, interruptions or discontinuity due to updating the web site or other malfunctions such as viruses.
BENU has adopted adequate technical and organizational security measures to protect services on BENUARTS.com, integrity of traffic data and electronic communications in order to prevent unauthorized use of or access to data, as well as to prevent risks of dissemination, destruction and loss of data and confidential/non confidential information regarding users of BENUARTS.com, and to avoid unauthorized or unlawful access to such data and information.
10. Our Business Policy
BENU has adopted a business policy; its mission consists of selling products through its services and its web site to "consumer" only. "Consumer" shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, BENU reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with BENU's policy and to any other purchase order which does not comply with our TOS.
It is not obligatory to register to our site in order to use our services (including the purchase of products) or features made available to you. However, if you wish to register, you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately at the following e-mail address email@example.com. We may also change registration requirements from time to time.
The account password you provide should be unique and kept secure, and you must notify us immediately of any breach of security or unauthorized use of your account.
12. Sales Policy
BENU offers products for sale on www.benuarts.com, which are available exclusively to its end users, i.e. the "Consumers" (also “you”).
These TOS also regulate the offer, transmission and acceptance of purchase orders relating to products on www.benuarts.com between you and BENU.
The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties that are on BENU through links, banners or other hypertext links. Under no circumstances shall BENU be deemed liable for the supply of services provided by third parties.
13. How to Execute a Contract with BENU
13.1 To place an order for the purchase of one or more products on BENUARTS.com fill out the online order form and send it electronically to BENU, following the relevant instructions.
13.2 The order form contains information on the main characteristics of each product ordered and the relevant unit price (including all applicable fees and taxes), the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and delivery costs, and references to the terms and conditions for returning purchased products.
13.3 An order shall be deemed submitted when BENU receives your order form electronically and the order information has been verified as correct.
13.4 After your order form has been submitted, BENU will process your order. Upon submission of an order form, BENU shall send you a purchase order receipt e-mail, containing a summary of the information related to the order form.
13.5 BENU may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that BENU has not carried out your purchase order specifying the reasons thereof. If the products displayed on BENU are no longer available at the time of your last access or once BENU has received your order form we shall inform you of the unavailability of the ordered products within ten (10) days from the day after BENU has received your order.
If the order form has been sent and the price has been paid for items that are no longer available, BENU will refund the amount paid for those items within ten (10) days from the day that the said price has been paid.
14. Guarantees and Product Price Indication
14.1 On BENU we offer for sale a collection of exquisite high quality products made by fair trade communities or artisans from all over the world.
14.2 As an e-commerce site, our collection reflects our passion for positive social change. Whether made by local artisans, from sustainable and recycled materials, or as a result of fair and ethical trade, the products we highlight stand out for their unique and impactful purpose. BENU does not sell second-hand products or, flawed products. However given that some of our products are created with old traditional hand crafting techniques with natural, recycled or sustainable materials, each product may be not exactly correspond in terms of image and colors, as it appears on our website, without this being considered as a defective product.
14.3 Prices (always in euros) are subject to change and will be as quoted on our site from time to time, except in cases of obvious error. Check the final price of sale before sending the relevant order form.
14.4 All Products sold by BENU come with an identification tag attached with a disposable seal. When trying on the products you should not remove or alter the tag or seal from the purchased products should you wish to return the purchased product.
15.1 Payment of the product prices and relevant costs for shipping and delivery must be made by using one of the procedures indicated on the order form.
15.2 BENU accepts the following payment methods:
-Credit Card: Visa, MasterCard, Maestro enabled debit cards.
-PayPal: Easily shop online without having to enter your credit card details on the website.
To register for a PayPal account, visit the website paypal.com.
The total will be charged to your card when the order is shipped.
15.3. On BENU, every purchase is made with maximum security thanks to the use of widely accepted set of policies and procedures intended to optimize the security of credit,debit and cash card transactions such as PCI DSS.
15.4. In the case of payment by credit/debit card, all details will be sent by encrypted protocol to National Bank of Greece or other banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by BENU except for performing the procedure relevant to your purchase or issuing refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases of fraud to the police. The price for the purchase of products and the relevant costs for shipping and delivery, as indicated in the order form, will be charged to your current account when the purchased products are actually shipped.
16. Shipping and Delivery of the Products
Delivery in Greece by registered mail (ELTA) is expected by the 3rd working day for orders placed by 12 GMT and delivery abroad is expected by the 5th working day for orders placed by 12 GMT
Delivery in Greece by our courier PORTA - PORTA is guaranteed (for Greece) on the next two working days for orders placed by 12 GMT. Working days are Monday to Friday. Orders are shipped from Athens Greece.
Our delivery costs are flat and there are no extra costs at delivery.
PORTA - PORTA is our courier for all shipments. As per ELTA’s policy, you will receive an sms or a call once your package has been dispatched/arrived. In case you don’t respond to the sms and/or phone call, a written notification will be delivered to you. In case of failure of delivery after three (3) working days, the procedure will be repeated for one more time. All orders are processed automatically and we are unable to expedite or delay shipping times.
17. Cancellation of Order, Exchanges and Returns of Products
17.1 You have the right to cancel your contract with BENU in relation to products purchased from our site, without any penalty and for any reason, by notifying us in writing by sending us an e-mail to the following address [firstname.lastname@example.org] within fourteen (14) calendar days ,beginning on the day you receive the products (or for purchases of multiple products,the day on which you received the last product).In this case you will receive a full refund of the price of the products.
17.2 You should return the products to BENU within fourteen (14) calendar days, in the same condition in which you received them and at your own expense. You have a legal obligation to take reasonable care of the products whilst they are in your possession. Kindly also note that the identification tag should still be attached to the products with the disposable seal. If you fail to comply with this obligation, we may have a right of action against you for compensation.
17.3 Exchanges are allowed in certain circumstances if requested not later than fourteen (14) calendar days from the date of delivery of the products by sending a relevant e-mail to the following address [email@example.com]. You may only request the replacement of one or more purchased products from a single order with products that are the same model but a different size and/or colour.
17.4 If you cancel the contract within the fourteen (14) calendar days, we will process the refund due to you as soon as possible and, in any event within: (a) where we collect the products from you through our approved courier, fourteen (14) calendar days of the day on which you gave notice of your cancellation; or (b) where you return the products yourself, fourteen (14) calendar days of the day we receive the returned products or, if earlier, proof of postage from you evidencing that you have sent the products back, within such time. BENU will refund the price of the product in full. You will be responsible for the cost of returning the products to us, provided that the reason for the return is not because of an error on our part or because the item is faulty or defective. You may be liable for, and we may deduct from any refund due to you, any diminution to the value of the returned products caused by your handling of the products, save to the extent necessary to ascertain the characteristics, functions or nature of the products. Other than as set out herein, you will not incur any fees as a result of your request for reimbursement.
17.5 You can return the products to BENU either by:
- the approved courier via the pre-paid, personalised return label enclosed in your original order, or
- by packaging the relevant products securely and sending them, at your own risk and cost, to BENU. For your protection, we recommend that you use a courier service if you choose to return the goods other than via the pre-paid mechanism and approved courier.
18. Return of damaged, defective or incorrect items.
18.1 Kindly note that our products are created with old traditional hand crafting techniques with natural, recycled or sustainable materials and a very thorough inspection is taking place by BENU before the product is carefully packed and shipped to you. If you are returning a product because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us. Kindly note that the identification tag should still be attached to the products with the disposable seal.
This right is additional to your statutory right to cancel as set out in section 16.
18.2 You must notify BENU via e-mail by sending a relevant photo of an error in respect of the products delivered or of a damaged or defective product within twenty (20) days of receipt.If a product becomes faulty after the twenty (20) days please contact Customer Care to obtain further returns information. You must return the products in the same condition in which you received them. You have a legal obligation to take reasonable care of the products whilst they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. The products should be returned to BENU within ten (10) working days following notification to BENU of the damaged or defective product.
18.3 BENU will examine all products returned as damaged or defective and will notify you of your refund via e-mail within a reasonable period of time. Subject to acceptance by BENU of the damaged or defective goods, products returned by you because they are damaged or defective will be refunded in full, including the cost of delivery for sending the item to you and the cost incurred by you in returning the item to BENU. In the event that BENU find no fault with the returned products, you will be notified that the returned products cannot be accepted and you may elect to have the products re-delivered to you.
19. Refund Procedures
19.1 The value date for the credit shall be the same as the value date of the original debit and consequently you shall not suffer interest losses.
19.2 We will usually refund any money received from you using the same method originally used by you to pay for the purchase.
19.3 BENU will refund the price of the products in accordance with the applicable time frame as specified in clause 16 or 17 above. To the extent permitted by applicable law, BENU shall not be responsible for any delay that is beyond its control including for delays caused by the method of purchase or refund, including by way of example:
- delay caused by credit card/debit card companies refund policies;
- payment by PayPal: refunds will be credited to your PayPal account and will be visible immediately. The actual reimbursement to the credit card associated with your PayPal account depends on the company that issued the card;
20. Governing Law
The TOS together with all our policies and procedures will be governed by and construed in accordance to the Greek law and the relevant courts of Athens, Greece will have exclusive jurisdiction.
Providing BENU with your personal data, which is requested at various collection times, may be necessary to carry out the purposes indicated in the appropriate information, or this may be optional. By registering and creating your account, you are consenting to the collection of your personal data. If an order is placed with us, we need to hold personal information including your name, email address, phone number(s), home address, shipping and credit/debit card billing address(es) so that we can process and fulfill your order.
Saved card details will never be shared with third parties and will only be used to process your order, using our payment partner's systems. Additionally we may also obtain information as a result of authentication or identity checks. Sometimes we may ask for your telephone number. This number may be given to our courier for delivery services. These details allow us to process your order and to let you know the status of your order.
The mandatory or optional nature of such provision is specified by the symbol(*) which is placed alongside information which is mandatory.
Any refusal to provide BENU with such data when this is marked mandatory renders it impossible to pursue the main purpose of that collection: such refusal could, for example, make it impossible for BENU to perform the purchase agreement, or to provide other services that are available on BENUARTS.com (help through our Customer Care, newsletters, registration for or use of the services offered by BENU). Supplying BENU with subsequent data, other than data marked as essential, is conversely optional, and does not result in any consequences in terms of completing the main purpose of such collection.
BENU may use your personal information for the processing of orders, payments and to provide you with a personalized shopping experience. We will also use your details to fulfill and deliver your orders and manage your account. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information. Your personal information may also be shared with the courier which handles the processing of data needed to perform shipping, delivery and returns for products purchased on our web site.
Your data will be communicated to third parties only with your express consent, except in cases where communication is mandatory by law or is necessary for the purposes prescribed by the law to pursue purposes for which the consent of the interested person is not requested; in these cases, data may be made available to third parties that will independently process it, and only for the aforementioned purposes.
Any processing purpose other than the one specified for which you have provided your personal data shall be demonstrated in the information and shall only be pursued by BENU upon obtaining your express consent.
We may also use your personal information to send you marketing updates/newsletters but only ever in accordance with your preferences and following your consent. We do not sell your details to third party marketing companies.
When you register, you will be given the option to opt-out of subscribing to our regular update service which will send you:Email alerts for new products, features, enhancements, special offers, upgrade opportunities, contests, events of interest, and one-off marketing promotions.
At all times, we will offer you the opportunity to unsubscribe out of any service or update to which you have subscribed, if you change your mind. Any e-mail we send you will contain an easy automated unsubscribe link so that you can opt-out of that particular mailshot. To opt out of direct mail service or updates, you may also send us an email to the following address [firstname.lastname@example.org] with a request to opt out of the direct mail service.
If for any reason you are concerned that the personal information held by BENU is not correct, please visit the website and, after logging into your account, your personal information will be made available for review and change in the "My Account" section. Only you may access your personal data from the website using your password. You can change or delete saved credit/debit card details each time you make a purchase. You will also be able to delete saved credit/debit card details by adding or editing a shipping/billing address. If you change your billing or shipping address while your order is still being processed, the order will be re-processed through security validation checks.
However, BENU may not guarantee to its users that the measures adopted for the security of the site and the transmission of the data and information on the site limit or exclude any risk of access without consent, or dissemination of data by devices belonging to the user: we advise you to make sure that your computer is equipped with adequate software to protect against the transmission in data networks, whether through input or output (such as updated antivirus systems) and that your Internet service provider has adopted suitable measures on network data transmission security (such as, for example, firewalls and spam filters).
Our site contains links to other web sites which may not have any connection to us.
BENU does not control nor does it perform monitoring operations on these web sites and their content.
